Face à la vacance présidentielle, la Cour de cassation doit pouvoir compter sur des magistrats intègres, guidés exclusivement par la Constitution. Apolitiques par fonction, ils sont les garants d’une justice impartiale, même lorsqu’ils statuent sur des affaires aux implications politiques.
Récemment, des acteurs politiques ont tenté de faire pression sur la Cour pour qu’elle comble le vide présidentiel, allant jusqu’à solliciter les juges en personne. Ces comportements, irrespectueux de l’institution et des règles de procédure, sont inacceptables.
Pourtant, la Cour n’a besoin d’aucune injonction pour agir. L’article 149 de la Constitution de 1987 (version non amendée) lui attribue explicitement cette responsabilité. La résolution n°1 du Conseil Supérieur du Pouvoir Judiciaire (CSPJ), loin d’être un renoncement, est une mesure de prudence face aux dérives d’une classe politique irresponsable. Elle ne remet pas en cause le devoir constitutionnel de la Cour.
Ainsi, face à l’urgence de pourvoir à la présidence pour assurer la stabilité de l’État, les magistrats de la Cour de cassation ne peuvent se dérober. Puissent la Constitution et les lois de la République s’imposer enfin en Haïti.
